Division of Marital Assets When Filing For Divorce in Utah

Utah is an equitable distribution state, which means that marital property is divided accordingly, based on the court’s decision. Now, as you may know, the most common way of dividing property after a divorce is 50-50, where each party gets one half of the property (or half of its value in cash if the other party wants to pay them off).  Each one of these has a set of special rules that apply. Here is how it works: when a couple files for a Divorce in Salt Lake City, after multiple hearings and consultations, the court will take all the assets into consideration and make the first division: the assets that were made during marriage, and the assets that belong to each of the two parties present – the separate property. Consult with a Family Law Attorney and learn how you can potentially avoid getting a divorce.
